Thank you for choosing Kynd Erth, a product of Amboda Pty Ltd. By booking an experience through our website www.kynderth.com, you have agreed to its terms of use. Please read the below mentioned terms and procedures in order to make sure that you´ve clearly understood the conditions of your preferred chosen experience booked through our website:

Pricing

Our pricing policy assures you of complete transparency. Our prices may or may not include taxes as they are catered to all nationalities. To ease transactions, our prices are in various currencies.

Unless otherwise mentioned, prices quoted on our website are charged on per person basis. Inclusions and Exclusions are clearly mentioned on the Tour Page. The published rates may change without prior notice, particularly in case of any unforeseen circumstance, such as increase in airline tickets, hotel rates, entrances fees, transport expenses etc.

Group Travel

Kynd Erth reserves the right to cancel a group if the minimum number of travellers are not met. Travellers will be provided with options to join another tour.

Payment

We accept almost all major credit cards as mentioned on the payments page. Full payment or the deposit amount must be done by credit card, and guests are entailed to provide their credit card number to complete the transaction. This charge, will be showed in your credit card statement from Amboda Pty Ltd.

All payments made via credit card will be credited to our bank account in Australia. Although your credit card may initially be debited by the value of the currency chosen, your bank may charge you bank charges such as currency conversion fees or similar. These charges are not levied by Kynd Erth or Amboda Pty Ltd.

Confirmation of Payment

Once the payment is done, our travel experts will send you a confirmation by e-mail. Its print can be produced as an evidence of payment to the service provider to redeem your tour package. But make sure that you´ve provided correct information pertaining to your travel requirements at the time of booking.

Cancellation

Every Experience on our website may has its own unique cancellation policy. In some cases there would be a mandatory forfeiture of the booking / deposit amount and in some cases the entire Experience booked is non-refundable. Before booking any Experience with Kynd Erth, client has to read these policies carefully.

Cancellation Procedures

Prior to requesting a cancellation, we recommend you to carefully read the cancellation rules that apply to your booked experience. For cancellation of all or any part of your reservation, make sure that you send a cancellation request to Kynd Erth in writing at hello@kynderth.com. Upon receiving your cancellation request, we will let you know through e-mail regarding the confirmation of booking cancellation as well as the fee that should be paid or forfeited. Kynd Erth will not be held responsible for any cancellation that has not been received from you or not confirmed by us.

No Show policy

You are expected to be punctual and adhere to the time-lines of the tour. If you fail to turn up for a sightseeing or activity which is a part of the experience, no refunds in part or full will be provided.

The same condition applies in the case of unused tickets, accommodations, sightseeing tours, trekking and hiking activities, car-rentals, airport transfers or chauffeur-driven services.

Likewise, rescheduling cannot be allowed for confirmed tours, transfers to and from airports, and other travel related services. The client will have to purchase for the rescheduled activities separately.

It is understood that there shall be no refund or compensation whatsoever for unutilized services whether as a matter of choice or caused by your fault or compelled by circumstances such as ill-health, weather or any other reason.

Force Majeure Events

A force majeure event is an unforeseeable or unpredictable event that prevents someone from fulfilling a contract. A force majeure event could be something like a natural disaster that damages the site or makes it inaccessible. If such an event were to occur, Kynd Erth or it’s partners would not be held liable for any damages.

Force Majeure Events includes war or threats of war, riots, strikes, terrorism, disease, natural catastrophes, adverse weather, fire, or similar calamities. Kynd Erth reserves the right to amend, postpone, or cancel tours in case of force majeure.

Code of Conduct

In the event of you travelling in a Group or on a Private Tour, you shall not behave in a manner which causes distress or annoyance to other tour participants, drivers, guides, porters, hotel staff etc. In case you behave in a manner which is rowdy and indecent, you may be asked to leave the group at your cost and peril. Kynd Erth will bear no responsibility to the loss of accommodation, transfers, trekking, hiking, sightseeing etc.

Itinerary Amendments

Activities such as Hiking, Trekking, Sightseeing etc. in your experience package are subject to change based on local / weather conditions, airway schedules and such other several aspects. Should this transpire, you will be provided with suitable options of similar value, however depending on its availability. At most, we shall inform you of any such changes in itinerary, before departure. Please note that Kynd Erth reserves complete right to implement minor amendments in itinerary at any time without reimbursement. Further, no reimbursement can be done in the event of vis major, such as flood and earthquake or similar occurrences deemed as Act of God.

Check-in & Check-out Policy

All accommodation will be provided in hotels, campsites or home stays as specified at the time of booking. In an event of unavailability of an accommodation as specified, all efforts will be undertaken to provide you with a suitable alternative of similar budget and standard. Check-in / check-out policies of accommodation will vary as per type of accommodation chosen. Kynd Erth cannot be held responsible for any early or late check-in and check-out requests which are not adhered by the hotel due to their internal policies.

Travel Insurance

Kynd Erth shall not be responsible for any kind of damages as an outcome of accident, illness, injury, or loss of personal baggage or even the cancellation of trip. It is advisable that the guest should avail of a travel insurance policy to tackle unforeseen events.

Travel Documents

Passport

It is the responsibility of every guest to ensure that he or she carries a valid passport to the countries they would be visiting. A passport should be valid for 6 months beyond the end of tour date or stay in the country.

Valid ID

In case a Child Discount, Student Discount or any such concessions are applied, the traveller has to carry a valid and original ID Card as mentioned in the Terms & Conditions of specific experiences.

Visa / Entry Permits

Guests are advised to check with the embassies / consulates of the countries they wish to travel regarding the need of visa and health requirements, as they are subject to change without prior notice.

No refund can be done in the event of loss or lack of these relevant documents.

No refund can be done if a guest in off-boarded during departure or is refused entry upon arrival.

Website Usage Restrictions

All content in this website, including logo, images, information on experiences, pricing details, and other relevant details, are proprietary to Kynd Erth & Amboda Pty Ltd. Accordingly, as a condition of this website´s usage, you agree not to exploit this website or its content for any non-personal, commercial, or illegitimate purposes. 

Liabilities

Kynd Erth is a tour organizer. We shall not be held liable for any loss, injury or damage with respect of life, limb, property, sickness, discomfort, additional expenses incurred by you or for any direct, indirect, consequential loss or damage of any kinds suffered by you howsoever. In case our liability arises from this contract, it is understood that it shall not exceed the total amount paid for the tour by you. Further in no case or circumstances shall Kynd Erth or Amboda Pty Ltd be held personally liable for any indirect, special or consequential losses or damages whatsoever.

Kynd Erth shall not be liable to you for refund, compensation, claim if the number of days is reduced, postponement or re-routing of any services due to any reason whatsoever. Kynd Erth is a booking agent for all experiences on our website and services provided are offered by overseas tour operators/service providers.

All information provided on our website are as offered by overseas operators/service providers also known as Destination Management Companies (DMCs). If in case any information provided on the website is not accurate, we shall make necessary amendments as soon as it comes to our knowledge. However, Kynd Erth or Amboda Pty Ltd cannot be held liable for loss or damage being suffered due any such information. It is understood that Kynd Erth does not control or operate any Airline, neither does it own any shipping company, coach or coach company or Hotel or Transport Services, and as such if any loss or damage is being caused due to such carriers or Hotel, Our Company cannot be held liable. 

Governing Law and Jurisdiction

Reading of Inclusions and Exclusions, the Terms & Conditions is mandatory.

“Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of Australia”.
